Wrongful Death
When a person is killed as a result of a negligent act of another person, the death is referred to as a wrongful death. The heirs or survivors of the deceased can sue the person who caused the wrongful death for damages. The claimant must prove that the death was caused by the negligent act of the defendant. The amount of damages that will be awarded is determined by an accounting of the deceased's medical bills and funeral expenses as well as the average income the deceased would have earned if he or she had not been killed.
