The claimant has to establish negligence on the part of the defendant and that the negligence was the cause of the injuries sustained in order to be awarded damages. The damages that can be awarded include compensatory damages and punitive damages. All medical malpractice claims have to be filed within two years of the date of the injury or the time at which the plaintiff discovered that he or she was entitled to sue. |
